Clery Act Compliance at Imperial Valley College 

Imperial Valley College is committed to providing a safe and secure environment for all students, employees, and visitors. In compliance with the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act—commonly known as the Clery Act—Imperial Community College District publishes and shares annual security information, policies, and crime statistics to promote transparency and accountability. 

About the Clery Act 

Originally enacted as part of the Crime Awareness and Campus Security Act of 1990, this federal law amended the Higher Education Act of 1965 to require all colleges participating in Title IV financial aid programs to disclose campus crime statistics and security policies. 

In 1998, the law was renamed to honor Jeanne Clery, a Lehigh University student who was tragically murdered in her dorm room in 1986. On March 7, 2013, the Clery Act was further amended when President Obama signed into law the Violence Against Women Reauthorization Act (VAWA), which expanded protections and reporting requirements for incidents involving dating violence, domestic violence, sexual assault, and stalking. 

What the Clery Act Requires 

Imperial Community College District publishes an Annual Security Report (ASR) in compliance with Clery Act requirements. This report must: 

  • Disclose campus security policies and three years of crime statistics 
  • Maintain a publicly accessible daily crime log 
  • Detail emergency response and evacuation procedures 
  • Issue Timely Warnings when crimes pose an ongoing threat 
  • Offer prevention and awareness programs for students and employees 
  • Outline the rights and resources available to victims 
  • Be available to students, employees, and job applicants 

All statistics are submitted to and published by the U.S. Department of Education. Institutions that do not comply may face penalties. 

 

Campus Security Authorities (CSAs) 

The Clery Act identifies specific individuals—called Campus Security Authorities (CSAs)—who are required to report certain types of crimes to the College Police Department. These individuals play a critical role in ensuring accurate reporting and campus safety. 

 

Who is a CSA? 

A CSA is anyone with significant responsibility for student and campus activities. At Imperial Community College District, CSAs may include: 

  • Vice President for Student Services 
  • Dean of Student Affairs and Enrollment Services 
  • Campus Safety Officers 
  • Title IX Officers 
  • Athletic Director and Coaches 
  • Clinical Mental Health Counselor (Student Health) 
  • Faculty and Club Advisors 

 

CSA Responsibilities 

CSAs are required to report Clery Act-qualifying crimes brought to their attention to the College Police, regardless of whether the individual reporting chooses to involve law enforcement or file charges. These reports help: 

  • Ensure crimes are included in the Annual Security Report 
  • Determine if a Timely Warning should be issued to protect campus safety 

 

Crimes That Must Be Reported by CSAs 

A CSA must all crimes and public safety incidents that are reported to them that fall under the Clery Act’s list of reportable crimes and occur within the College’s Clery Geography for including in the Annual Security Report, regardless of whether or not the victim chooses to file a report with law enforcement or press charges. Any CSA who becomes aware of a Clery-reportable crime must report the incident to the Campus Safety & Parking Control Department as soon as possible, in order to ensure that the District  complies with the Timely Warning provision of the Clery Act if applicable. Apart from contacting Campus Safety Officers, On-Campus Deputy Sheriffs are also available to receive reports about what happened on campus. Information forwarded by CSA’s to Campus Safety & Parking Control Department is for statistical purposes to determine whether a timely warning should be issued to the campus community. 

  • Arson  
  • Criminal Homicide (Murder, Non-negligent Manslaughter, Negligent Manslaughter) 
  • Robbery 
  • Burglary (excluding vehicle burglary) 
  • Motor Vehicle Theft 
  • Aggravated Assault 
  • Dating Violence 
  • Domestic Violence 
  • Stalking 
  • Sexual Offenses (Rape, Fondling, Incest, Statutory Rape) 
  • Hate Crimes 
  • Weapons Violations 
  • Alcohol Violations 
  • Drug Violations 

 

Who is Not a CSA? 

The following individuals are not considered CSAs, unless they hold additional roles involving student supervision: 

  • Faculty without responsibilities beyond teaching 
  • Clerical and administrative staff 
  • Cafeteria, facilities, and maintenance staff 

Additionally, Professional Mental Health Counselors operating within the scope of their license are exempt from reporting requirements under the Clery Act, and the district is not required to issue Timely Warnings based on confidential reports made to them.
